The Lebanese Parliament voted the new Public Procurement Law
On its 25th anniversary, the Institute planted the seeds for the upcoming 25 years.
Happy to announce that the Lebanese Parliament voted on June 30, 2021, the new Public Procurement Law.
This law was prepared by the Institute’s team in collaboration with 13 Lebanese and international experts in an inclusive consultative approach based on evidence and comparative analysis, and the recommendations of MAPS assessment of the public procurement system.
The law which is based on UNCITRAL model law and OECD principles underwent an in-depth discussion at the Parliamentary Subcommittee. 50 consultation meetings and more than 120 hours of discussions were organized over a whole year. More than 45 consultation sessions with policy makers, civil society, representatives of the public and private sectors and of the donor’s community took place to ensure ownership and buy-in.
With the voting of the Public Procurement Law, Lebanon has ticked the first box in the list of needed structural reforms.

Le Parlement libanais a voté la nouvelle loi sur les marchés publics
À l’occasion de son 25ème anniversaire, l’Institut des Finances Basil Fuleihan a semé des graines pour les prochaines 25 ans.
Ainsi, nous avons le plaisir d’annoncer que le Parlement libanais a voté le 30 juin 2021 la nouvelle loi sur les marchés publics, préparée par l’équipe de l’Institut, en coopération avec 13 experts libanais et internationaux.
La loi a été élaborée selon une approche participative et sur la base d’études comparatives, des données et des recommandations du diagnostic MAPS. Elle est basée sur la loi type de la Commission des Nations Unies pour le droit commercial international sur la passation des marchés publics et sur les principes de l’OCDE.
La loi a fait l’objet de débats approfondis au sein de la sous-commission parlementaire. 50 réunions de consultation et plus de 120 heures de discussions ont duré une année entière. Par ailleurs, plus de 45 séances de consultation ont été organisées avec les décideurs, la communauté internationale, la société civile, ainsi que les représentants des secteurs public et privé pour expliquer et examiner le projet de loi et assurer l’appropriation.
Avec le vote de cette loi clé, le Liban a avancé un premier pas sur le long chemin des réformes structurelles.

مجلس النواب اللبناني يقرّ قانون الشراء العام الجديد
في عيده الـ٢٥ يزرع معهد باسل فليحان المالي والاقتصادي بذوراً للسنوات الـ25 القادمة.
ويتشرّف بإعلامكم أنّ الهيئة العامة للمجلس النيابي قد أقرّت في جلستها المنعقدة في 30 حزيران 2021 قانون الشراء العام الجديد الذي أعدّه فريق المعهد بالتعاون مع 13 خبير لبناني ودولي.
وُضع هذا القانون بحسب منهجية تشاركيّة مبنية على الدراسات المقارنة والبيانات والتوصيات المبيّنة في مسح MAPS لمنظومة الشراء العام، وهو يتماشى مع أفضل المعايير الدولية المعتمدة. خضع القانون لمناقشة معمّقة في اللجنة النيابية الفرعية خلال أكثر من 50 جلسة وأكثر من 120 ساعة نقاش امتدّت على مدى عام كامل، كما نوقش في اللجان النيابية المشتركة في جلستين متتاليتين، قبل إقراره في الهيئة العامة. كما نُظمت أكثر من 45 جلسة نقاش مع ممثلي المنظمات الدولية والمجتمع المدني والقطاع العام والخاص.
مع إقرار قانون الشراء العام يكون لبنان قد وضع نفسه على سكة الإصلاحات المطلوبة.
